TERMS AND CONDITIONS
1. Cancellations, Terminations, and Refunds :
1.1. Both parties agree that this contract is conditional upon THE CLIENT fulfilling all of his/her obligations in a satisfactory manner, as deemed by Indium Photo. THE PHOTOGRAPHER reserves the right to terminate this Contract and /or remove THE CLIENT from the studio, or other location of shooting, at any time without a refund if he/she is engaged in behavior including, but not limited to; illegal actions, belligerent, inappropriate, or disruptive behavior as deemed by THE PHOTOGRAPHER. THE PHOTOGRAPHER may terminate this contract at any time if he/she feels that THE CLIENT is not performing in a manner acceptable to the company, or the terms and responsibilities of this Contract are not being met.
1.2. THE CLIENT agrees that any cancelation must be in writing. No monetary reimbursement will be provided.
1.3. THE CLIENT agrees that in the event that Indium Boudoir INC cancels the session for any reason, including but not limited to; medical emergency, family emergency, inclement weather, road closures, natural disaster, closure of venue, or similar catastrophe, THE CLIENT will not receive a refund, instead a reschedule for a Boudoir Photography Session, to be used within 190 DAYS time.
2. PAYMENT SCHEDULE AND FEES :
2.1. THE CLIENT agrees that the paid amount is non-refundable in order to hold reservation/date with Indium Boudoir INC. THE CLIENT agrees that if he/she needs to reschedule, there will be a $350 Reschedule Fee for every reschedule. If THE CLIENT reschedules on THE PHOTOGRAPHER 30 Days, or less, prior to the original agreed upon appointment, THE CLIENT will be charged a $500 Rescheduling Fee. THE CLIENT's new appointment must be within 90 days of original appointment to avoid losing the original booking fee. If THE CLIENT surpasses 1 reschedule, THE CLIENT agrees that the initial contract becomes void, the initial booking fee is forfeited, and that THE CLIENT is subject to the most current pricing options. All payments made, excluding the original booking fee and any rescheduling fees, are valid as a credit towards any other sessions or products with Indium Boudoir. This credit will expire if not used within 1 year from the original appointment date.
THE CLIENT agrees that if he/she needs to cancel, THE CLIENT will be charged a $500 Cancellation Fee. THE CLIENT agrees that the initial contract becomes void and that THE CLIENT is subject to the most current pricing options if THE CLIENT decides to re-book at a later time. All payments made, excluding any reschedule and/or cancellation fees, are valid as a credit towards any other sessions or products with Indium Boudoir. This credit will expire if not used within 1 year from the original appointment date.
2.2. THE CLIENT agrees that if the retainer or any payments are deemed NSF, he/she is responsible for a $40 SERVICE FEE. THE CLIENT agrees that his/her photos will not be ordered until a new final balance has been paid in full and cleared. Pricing may change without notice and is only guaranteed on products and services selected at the time of Contract signing.
2.3. THE CLIENT agrees that he/she may not remove items from this Sales Contract once it has been signed. THE CLIENT understands that he/she is responsible for paying for the items selected on the Contract according to the payment due date. If THE CLIENT falls behind on payments, THE CLIENT will request a new payment schedule to better fit his/her needs. The CLIENT understands the balance is due in full 2 weeks prior to the appointment date. If THE CLIENT fails to pay in full 2 weeks prior, Indium Boudoir INC reserves the right to cancel the appointment and does not have to provide THE CLIENT with any images or monetary compensation for monies paid, including, but not limited to; compensation for time or emotional stress, the booking fee and payments towards the balance by the client or any other person contributing towards their contractual balance.
2.4. THE CLIENT understands that Indium Boudoir INC chooses the best selection of photographs for viewing. Files not chosen for viewing by Indium Boudoir INC are not available for purchase or viewing. Any images not chosen by THE CLIENT during the ordering appointment will be permanently purged once THE CLIENT leaves said ordering appointment. Additional products may not be added at a later date. Orders cannot be downgraded or canceled. Due to the custom nature of photography, no refunds or exchanges. All sales are final and all monies paid are non-refundable.
